चंडीगढ़. पूर्व सांसद एवं वरिष्ठ भाजपा नेता सत्यपाल जैन का कहना है कि लिब्रहान आयोग की रिपोर्ट कोई न्यायिक फैसला कम और आरएसएस व भाजपा के खिलाफ थिसिस ज्यादा लग रहा है। उनके मुताबिक यह रिपोर्ट लाल कृष्ण आडवाणी और मुरली मनोहर जोशी को टारगेट बनाकर लिखी गई है। ...
सत्यपाल जैन इस मामले में भाजपा नेताओं के वकील भी हैं। उनका कहना है कि लिब्रहान आयोग ने आयोध्या में 6 दिसंबर, 1992 को गिरे विवादित ढांचे की जांच रिपोर्ट 17 साल के बाद 30 जून, 2009 को केंद्र सरकार को सौंप दी थी। सरकार की इसे विभिन्न चरणों में लीक करने की मंशा थी। कुछ अखबारों और टीवी चैनलों में यह रिपोर्ट लीक होने के बाद जब भाजपा ने इसका विरोध किया तो मंगलवार को आयोग की रिपोर्ट दोनों सदनों में रखी गई है।
उनका कहना हैं कि यह रिपोर्ट लीक होने की केंद्रीय गृह मंत्री को नैतिक जिम्मेदारी लेते हुए अपने पद से इस्तीफा दे देना चाहिए। उनके मुताबिक इस रिपोर्ट की एक कॉपी जस्टिस लिब्रहान के पास थी तो दूसरी कॉपी प्रधानमंत्री को दी गई थी।...
...उनके मुताबिक आयोग ने जो रिपोर्ट तैयार की है, उससे देश हक्का-बक्का रह गया है।
इसमें पूर्व प्रधानमंत्री अटल बिहारी वाजपेयी, स्वर्गीय प्रमोद महाजन को भी दोषी ठहराया गया है जबकि आयोग ने अपने कार्यकाल में उन्हें सम्मन तक जारी नहीं किया। दूसरी तरफ पूर्व प्रधानमंत्री दिवंगत नरसिम्हा राव आयोग के सामने पेश हुए थे जिनकी एविडेंस भी हुई लेकिन आयोग ने उनकी भूमिका का कोई जिक्र भी नहीं किया है।
जैन ने लिब्रहान आयोग की रिपोर्ट को तर्कहीन, अर्थहीन बताते हुए कहा कि इसमें साक्ष्यों की सही ढंग से व्याख्या नहीं की गई है।...

‘Liberhan report is like a thesis against BJP, RSS’

Nov 25, 2009 | Chandigarh. Coming down heavily on the Liberhan Commission report that probed the demolition of Babri Masjid 17 years ago, the BJP today alleged that it was "perverse, unfounded, vague and uncertain" and like a "thesis" against the saffron party and the RSS.
"The Commission's report is perverse, unfounded, and has drawn its conclusions without any logic, without meaning and without appreciation of the evidence. The findings of the report, which is like a thesis against the BJP and the RSS, are vague and uncertain," senior BJP leader and former MP, Satya Pal Jain told a news conference here this evening.
He alleged that the Justice M S Liberhan Commission report tabled in both the Houses of the Parliament on Wednesday, appears to target senior BJP leaders including L K Advani and Murli Manohar Joshi.
Jain, who appeared as Advani's counsel before the Commission, also expressed surprise as to how former Prime Minister Atal Bihari Vajpayee had been indicted "when he was not summoned even once by the Commission".
"It's ironical that the Commission has remained silent on the role of former Prime Minister P V Narasimha, who deposed before the Commission (during whose tenure the Masjid was brought down). The entire nation has been left in a state of shock and surprise how Vajpayee was indicted when he was not even summoned once," he said, adding late BJP leader Pramod Mahajan had also not been given any opportunity to present his view before the Commission.
Jain also alleged that the Union Home Minister P Chidambaram and the Home Ministry had "intentionally selectively leaked the Commission report in the media".
He said that Chidambaram should own the "moral responsibility" for the "leakage" of the report and step down as Home Minister.
Jain alleged that the Congress party wanted to derive political mileage and shift the nation's focus from burning issues like inflation and terrorism, "which is why they leaked the report at a time when it suited them best".
"The Congress also had an eye on the minority votes as first phase of elections in Jharkhand was held today," he alleged.
To a question, Jain said that the then Advani's Personal security Officer, Anju Gupta Rizvi had also deposed before the Commission and admitted that Advani never wanted the structure to be brought down and when he was proceeding towards the Masjid, he was prevented from going there due to security reasons.

Wednesday 25th November, 2009 (IANS): Senior Bharatiya Janata Party (BJP) leader L.K. Advani's counsel Satya Pal Jain Wednesday said the findings of the Liberhan Commission into the 1992 Babri mosque demolition were 'vague and uncertain'.
'The findings of the commission are vague and uncertain. They are targeting L.K. Advani, Murli Manohar Joshi and other leaders without proper evidence,' Jain, who represented Advani before the Liberhan Commission, told mediapersons here.
He added that the commission's report was deliberately delayed from being tabled in parliament by the government to suit its political interests.
'The report itself looks like a thesis against the BJP and RSS (Rashtriya Swayamsevak Sangh),' said Jain, a former BJP Lok Sabha MP.
He said that the BJP was fully prepared to rebut the findings of the report when discussion on the issue begins in parliament Dec 1.
He said that former prime minister Atal Bihari Vajpayee has been found 'culpable' in the demolition despite neither being called for any hearing nor any evidence being collected against him.
Jain wondered how then prime minister P.V. Narasimha Rao could be let off by the Liberhan Commission despite evidence being recorded against him for inaction.
Jain also sought that Home Minister P. Chidambaram resign from his post on moral grounds following the 'selective leak' of the Liberhan report by the home ministry before it was tabled in parliament. ...

Not only Justice M S Liberhan, but also both lawyers of the commission — Anupam Gupta and Harpreet Singh Giani — are from here. Incidentally, the man who represented BJP leader L K Advani before the commission, senior advocate Satyapal Jain, is also a practicing lawyer in Punjab and Haryana High Court.

Commenting on the report, Jain said the report was perverse, unfounded and a thesis against BJP and RSS. ‘‘Nothing substantial has come out in 17 years, except huge loss of taxpayers’ money,’’ Jain added.

Lok Sabha deputy leader of Opposition Sushma Swaraj charged that Chidambaram was personally responsible for the leak of the report and not just his Ministry. “Chidambaram should own moral responsibility and resign before the debate. He cannot escape responsibility by merely calling the leak unfortunate,” she said....
... The BJP has pressed into service the party’s best legal brains like Arun Jaitley, Satya Pal Jain, counsel of Advani in the Babri Masjid demolition cases and in the Liberhan Commission, and Sushma Swaraj to search for grounds on which the party could decline the report.
The party has declared that the principles of natural justice were violated by indicting former Prime Minister Atal Behari Vajpayee. “The principles of natural justice demanded that Vajpayee should have at least been summoned and his version heard, before commenting on him,” party sources said.
