Himachal Pradesh State BJP in-charge, Satpal Jain today demanded national consensus on the appointment of Chief Parliamentary Secretary and Parliamentary Secretary in state governments across the country.
Answering queries of reporters about the induction of CPSs in the state government Mr Jain clarified that a number of states including Punjab, Haryana, Rajasthan and Jharkhand have CPSs and PSs in their governments.
He said there should be a national consensus on the issue and a National Act should replace the individual state laws.
Mr Jain said he had joined this issue to argue it in the Himachal Pradesh High Court as a lawyer, and pleaded against the appointment of the CPSs and PSs by the former Congress government in a PIL filed by convener of Citizen Rights Protection Forum, Desh Bandhu Sood.
He argued the PIL was not filed by the party and the BJP had no role in that case in the court. He said the High Court had quashed the appointments on the ground that there was no legal provision in the law to appoint the CPSs and PSs in the state at that time.
He said that now, the BJP government had appointed three CPSs as there was a legal provision of HP Parliamentary Secretaries (Emoluments, Allowances and Appointment) Act 2006, which was passed by Vidhan Sabha after disqualification of the CPSs and PSs during the Congress regime.
He said the legal provision is enough to accommodate the CPSs and PSs in the government. ...

Himachal ministry expanded, two inducted

Shimla, July 9 (IANS) After 18 months of coming to power in Himachal Pradesh, the Bharatiya Janata Party (BJP) government Thursday expanded its 10-member ministry for the first time, inducting two ministers।
Jai Ram Thakur, a former state BJP chief, and Mohinder Singh – both legislators from Mandi district – were sworn-in by Governor Prabha Rau at Raj Bhavan here.
Chief Minister Prem Kumar Dhumal, senior party leaders like Satya Pal Jain, Manohar Lal and Mohinder Pandey and senior officials were present at the ceremony।
Talking to reporters later, Dhumal said with this expansion, both the vacancies in the ministry have been filled, as per the constitutional amendment which has fixed the size of a ministry in the state at 12.
The chief minister said that the portfolios of the two new ministers would be announced later। ...

HC summons complete records of lower courts

CHANDIGARH: The Punjab and Haryana High Court has summoned the complete records of lower courts, Panchkula, that had set aside the election of Ravinder Rawal for the post of MC president. High court has summoned the records after hearing the contentions and reply of VK Sood, who had challenged his election in lower court, Panchkula, following which it was held void.
In his reply, VK Sood on Thursday contended that the appeal filed by Rawal in high court is not maintainable because Section 275 of Haryana Municipal Act clearly states that award given by the election tribunal and district and sessions judge is final in case of any issue involving the election of office-bearers of municipal council (MC).
While arguing before the bench, Sood’s counsel Satya Pal Jain contended that to misled the court, the Panchkula deputy commissioner has concealed some instructions of Municipal Act while deposing before the courts on the issue.
Meanwhile, the DC, Panchkula, also moved an appeal on Thursday against the Panchkula district court orders whereby the election of Rawal was held void. In his petition, the DC pleaded before the HC that election of the MC president was set aside by the lower court merely on the apprehension of disclosure of identity of vote but there is no independent evidence to support breach of secrecy. ...
