BJP to oppose OoP Bill if govt brings without making changes

Shimla, Jun 29: BJP today said it would oppose the Office of Profit Bill if the UPA government brings it again without making changes as suggested by President A P J Abdul Kalam while returning the Bill.
"BJP will move the Supreme Court if the government tries to rush the Bill in the same form," Convenor of BJP legal cell Satpal Jain told reporters here.
Congress is avoiding a national debate on the issues raised by the President and is trying to bail out left parties members, he claimed. ...

Shimla, June 29: THE Bharatiya Janata Party is all set to take its fight against former Chief Parliamentary Secretaries and Parliamentary Secretaries, who have just received some reprieve from the Election Commission of India, to the state High Court.
The EC has turned down BJP's plea for disqualification of the 12 Ex-CPSs and PSs - an issue which was referred to the Commission by state Governor V.S.Kokje early this year. Says Satya Pal Jain, a noted lawyer and head of the BJP's all India legal cell: "It's a fit case to challenge the EC order and also Himachal Pradesh (Prevention of disqualification of members) Act 1971".
Speaking to newsmen Jain claimed that after the constitutional amendment relating to downsizing of the ministries, the Himachal law has become infructous. This point was also raised in the PIL relating to appointments of CPS and PS but the court had left it undecided. ...

NEW DELHI | June 24: BJP President Rajnath Singh today asked the party's Legal Cell to make people of the country aware of the efforts of the UPA government to undermine and degrade the Counstitutional and Statutory institutions. ...
   ... BJP Legal Cell Convenor Satyapal Jain in his address said there were over 2.7 crore pending cases in various courts of the country and the government had not taken steps to appoint judges to clear the long list of pending cases in the country.
   The Legal Cell would form its units right upto Tehsil levels by August 2006 and offer free legal advice to the poor and find out ways for settlement of disputes at the initial stages itself. These units would prove to be the vehicles for spreading the message to the people on several current topics. ...

File PILs on OoP, graft: BJP to its state legal cells

NEW DELHI, JUNE 24: The BJP today asked its legal cells in states ruled by other parties to use public interest litigation as a weapon against corruption and lawmakers holding offices of profit.
BJP legal and legislative business cell convenor Satya Pal Jain told reporters that the party believed PILs can help check corruption and violation of laws relating to office-of-profit.
"We have asked our legal cells to use PILs for action against corruption in public offices and against those lawmakers who are wrongfully holding offices of profit," Jain said after a meeting of his cell's national executive.
The former MP, who alleged that office-of-profit rules were being violated most in non-BJP states, said his party's legal cells would be actively filing PILs in Congress-ruled states.
In his address to the meeting, party chief Rajnath Singh hailed judiciary for its intervention to offset, what he called, attempts by the ruling UPA to undermine constitutional proprieties.
Singh, who cited the Supreme Court verdict in Bihar Assembly dissolution case, insisted that the "failure" of executive has led to judicial activism.
"The executive has failed and so have the politicians in carrying out their duties, but the judiciary commands the highest respect in society," Singh said.
The BJP also decided to hold state-level conferences from next month and a national conference in Delhi in November on the ruling UPA's handling of constitutional issues.

CHANDIGARH, JUNE 22: FORMER MP Satya Pal Jain today strongly criticised the Railway Ministry for "not putting to use the newly-constructed Ludhiana-Chandigarh railway line, which is ready since April 1, as it is not finding suitable VIP for its inauguration."
Jain, while addressing a press conference, said if the railway line was not put to use immediately, the BJP would start agitation and expose "the callous and indifferent attitude of the government towards this project."
He said the party would hold a black flag protest demonstration on the track, starting from Chandigarh Railway Station on July 1.
Jain said the residents have been demanding the construction of railway bridge near Modern Housing Complex, near Manimajra, and Vikas Nagar, Mauli Jagran, to avoid traffic congestion at the time of passing of trains, but nothing has been done to date. He said the quality of food and other services on Shatabadi had gone down, but no action has been taken.

CHANDIGARH, JUNE 19: The Bhartiya Janata Party led by Mr Yash Pal Mahajan, president of the local unit and Mr Satya Pal Jain, national convener of the legal cell, today presented a memorandum addressed to Mr A.P.J. Abdul Kalam, President of India, through Mr R.K.Rao, Deputy Commissioner, in connection with the "unprecedented" price hike.
The memorandum was submitted as a part of the decision taken by the NDA for staging 'dharnas' and holding demonstrations at all district headquarters. It was pointed out that during the Congress rule there have been at least three hikes in prices of essential commodities. ...

BJP's office-of-profit stir gets legal

GANGTOK, JUNE 13: The BJP's consistent protest against the controversial office-of-profit Bills at the Centre and in Sikkim was outlined here today, with the BJP threatening to knock the doors of the court against the Bills.
Addressing a Press conference here today, Mr Satyapal Jain, convenor, BJP's legal and legislative business cell, said: "The BJP will oppose the office-of-profit Bill in the next Parliament session. MPs and MLAs throughout the country should not be allowed to hold offices of profit, except those offices concerned with parliamentary affairs as per the Constitution."
Mr Jain, who is also a senior advocate, said he had come to Gangtok to fight a case filed in Sikkim High Court by the state BJP unit last year, against certain offices of profit granted to some MLAs and supporters of the ruling SDF government. ...
... The state BJP unit will submit a memorandum to the Governor soon. Even if the Governor gives his nod, Mr Jain said the BJP will move the High Court.
Recently, the UPA government had passed a Bill, exempting 46 posts as offices of profit, which was later returned by the President for reconsideration.
Mr Jain welcomed the President's action and said it was a slap on the face of the Congress-led UPA government. ...

Calling the bill unconstitutional at a press conference here, Jain said by returning the bill to the Cabinet the "President had dealt a blow to the Congress-led coalition which stood exposed over the issue". ...

        Ordinarily, the quota debate in the BJP and divergent perceptions in the saffron camp over the issue, should have been a cause of relief for the Congress.
        But the arguments put forward by the anti-quota sections in the BJP are making the Congress quite uncomfortable. For, it points to the devastation that quota can wreak on the Congress in poll-bound Punjab and Uttaranchal, where the OBC population is marginal.
        The recently-concluded BJP national executive saw leader Satpal Jain from Chandigarh raise vociferous objections to the quota proposal. ...
